1. Overview
nicolacodes.com is a portfolio and professional services site operated by Nicola Riker Urdaneta ("I", "me", "my"). These terms govern your use of this website and any freelance services arranged through it.
2. Use of This Site
You agree to use this site only for lawful purposes. You may not:
- Attempt to gain unauthorized access to any part of the site or its systems.
- Use automated tools to scrape, crawl, or harvest content without permission.
- Submit false or misleading information through the contact form.
- Use the site in any way that could damage, disable, or impair its availability.
3. Intellectual Property
All content on this site — including designs, code, text, graphics, and the "blueprint" visual aesthetic — is my intellectual property or used under license. You may not reproduce, distribute, or create derivative works without written permission.
Project work completed for clients is governed by the terms of our individual agreement. Unless otherwise stated in writing, I retain the right to display completed work in my portfolio.
4. Freelance Services
Estimates. Pricing and timelines shown on this site (including the pricing calculator) are estimates only and do not constitute a binding offer. Final pricing is determined through direct consultation and a signed project agreement.
Project agreements. All engagements are governed by a separate project agreement or statement of work that will outline scope, deliverables, timeline, payment terms, and IP transfer. These terms supplement — but do not replace — any signed project agreement.
Payment. Unless otherwise agreed in writing, projects require a deposit before work begins. Specific payment schedules are outlined in individual project agreements.
Revisions and scope. The scope of revisions included in a project is defined in the project agreement. Requests beyond the agreed scope may incur additional charges at my standard rate.
5. Limitation of Liability
This site is provided "as is" without warranties of any kind, express or implied. I do not guarantee that the site will be available at all times or free from errors.
To the fullest extent permitted by law, I shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this site or reliance on any information provided here.
6. External Links
This site may contain links to third-party websites. I am not responsible for the content, privacy practices, or availability of external sites. Visiting external links is at your own risk.
7. Indemnification
You agree to indemnify and hold me harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these terms or misuse of this site.
8. Governing Law
These terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of El Paso County, Colorado.
